Tobin S. Klusty is a dedicated civil rights and employment attorney who zealously advocates for his clients at all stages of litigation. He is dedicated to ensuring the legal system is used to protect and advance civil liberties and individual rights, especially the rights of employees and community members who are often marginalized and disenfranchised by employers and the government.
Tobin moved to Washington after graduating from law school with honors and having earned multiple awards and accolades. He first worked as a public defender for the Snohomish County Public Defender Association. In this role, he tirelessly helped his clients access essential services and defend them against the criminal legal system. He successfully litigated several jury trials and argued countless motions. He also challenged unlawful court orders that violated his clients’ constitutional and statutory rights. In doing so, he developed his fierce litigation style and now well-known tact of tenaciously advocating for his clients’ rights at all stages of litigation.
After several years as a criminal defense attorney, Tobin transitioned into his current role as a civil rights and employment attorney. He first worked for a private firm where he successfully litigated several lawsuits in state and federal courts against employers and state actors who unlawfully discriminated and retaliated against his clients. Throughout these cases, he applied his bedrock litigation skills to help his clients obtain substantial results. This included his work with a team of litigators that achieved a $15 million settlement for employees in a multi-state wage theft class action.
Tobin has also used his experience to give back to the community through volunteering. As the former Chair of Washington State Bar Association’s Civil Rights Law Section, he worked with civil rights advocates and community members to promote the advancement of civil liberties. He also represented a client pro bono before the Washington State Supreme Court, where he successfully argued that law enforcement cannot detain transit passengers when no criminal activity is suspected.
Tobin is a member of the Washington State Bar Association and the Washington Employment Lawyers Association (WELA). He is admitted to practice in all Washington State courts and the U.S. District Court for the Western District of Washington.
Outside of work, Tobin loves spending time with his partner, Jenna, and his two pitties, Ike and Kenny. And together, they love hiking, backpacking, and overlanding in their Jeep.
